EU suspends copyright treaty ratification

The European Commission, facing opposition in city streets, on the Internet and in the halls of parliament, has suspended efforts to ratify a new international anti-counterfeiting agreement, and instead will refer it to Europe's highest court to see whether it violates any fundamental EU rights.

EU Trade Commissioner Karel De Gucht asserted Wednesday that an opinion from the European Court of Justice would clear away the fog of misinformation surrounding the Anti-Counterfeiting Trade Agreement, known as ACTA.

"This debate must be based upon facts and not upon the misinformation or rumor that has dominated social media sites and blogs in recent weeks," De Gucht told reporters in Brussels.

The decision appeared to reflect recognition by European Union officials of the political obstacles. Protests against the agreement were staged earlier this month in several European capitals ? including Berlin, Helsinki, Paris and Vienna ? by critics who say the agreement would stifle free speech and access to information.

The hacking group known as Anonymous claimed responsibility last week for a new series of hacks against the U.S. Federal Trade Commission and consumer rights websites. The sites were replaced with a violent German-language video satirizing ACTA.

ACTA has been under negotiation for years. Its drafters say it is needed to harmonize international standards to protect the rights of those who produce music, movies, pharmaceuticals, fashion goods, and a range of other products that often fall victim to piracy and intellectual property theft.

The U.S. has signed the agreement. Others include Australia, Canada, Japan, Morocco, New Zealand, Singapore, and South Korea. Mexico and Switzerland participated in the negotiations but have not yet signed.

The EU and 22 EU Member States signed ACTA on 26 January 2012 in Tokyo. Although the European Council ? the European Union heads of government ? unanimously approved ACTA in December, for the EU to be a party to the treaty, all 27 member countries would have to formally ratify it.

The treaty has been questioned by members of the European Parliament. On Sunday, European Parliament President Martin Schulz told Germany's ARD television: "I don't find it good in its current form."

He said the necessary balance between copyright protection and the individual rights of Internet users "is only very inadequately anchored in this agreement."

And in a statement Wednesday, David Martin, a spokesman on the issue for the Socialists and Democrats, the second largest bloc in the Parliament, welcomed the decision to get the court's opinion.

"Trade Commissioner Karel de Gucht today admitted that there are still many question marks about ACTA and what the implementation of the agreement, as it stands, would mean for citizens and for the freedom of the internet," Martin said. "The Parliament has been calling for more clarity for a long time, and we already requested legal opinions from several committees in the European Parliament. Now this ruling will be a good guarantee for the impact on fundamental rights.

EU officials say the agreement will not change EU law. They insist what was legal pre-treaty would remain legal the day after, and what was illegal would remain illegal. But they have said the EU must ratify it as an example to other countries where intellectual property rights are less protected than they are in the EU in order to protect European products and ideas from being stolen elsewhere.

"ACTA will not censor websites or shut them down; ACTA will not hinder freedom of the internet or freedom of speech," De Gucht said.

However, opponents fear ACTA would lead to censorship and a loss of privacy on the Internet. And the plan to gain court approval of the agreement has left at least some of them unimpressed.

"No legal debate can fix ACTA or give it a legitimacy that by design it cannot have," said Jeremie Zimmermann, co-founder of the Internet advocacy group La Quadrature du Net.

SAN DIEGO ? You?ll often hear that the immigration debate suffers from a lack of political will. But what it really needs is honesty and clarity.

And so, thank goodness for people like Peter Brimelow. His beliefs are vile, dangerous and antithetical to the greatest traditions of this country. But what is extremely helpful is that he?s honest and clear about what he believes.

Brimelow is convinced that ? as he recently told a reporter for CBS News ? ?diversity is weakening American identity.?

He is not alone. A few years ago, commentator Patrick Buchanan published a book where he argued that the United States was better off when most of the immigrants to its shores came from Europe and not Africa, Asia, and Latin America.

Question: What do immigrants from those parts of the world have in common?

Answer: They?re not white.

Brimelow shares his beliefs on the website he founded ? VDARE.com. The site is named in honor of Virginia Dare, the first child born to English settlers in America before all that dreadful race mixing and diluting of bloodlines occurred. He writes books like his best-seller ?Alien Nation: Common Sense About America?s Immigration Disaster.? And he also gives speeches and appears on panels like the one in which he participated recently at the Conservative Political Action Conference (CPAC) titled: ?The Failure of Multiculturalism: How the Pursuit of Diversity Is Weakening the American Identity.?

We have words to describe people like this and most of them end in ?-ist.?

Most Americans are not as honest or as clear as Brimelow. They waste a lot of time and effort trying to keep up appearances and pretending to be more progressive and open-minded about immigration than they really are. They?ll deny until their last breath that they have anything against immigrants who come to the United States legally from countries like China, Pakistan, India or Brazil. Why, this is a country of immigrants, they?ll say. It?s only illegal immigration they have a problem with, they?ll insist.

That?s not true. The three dirty little secrets about the immigration debate are that how Americans feel about immigrants has a lot to do with what country people are coming from, that racism and xenophobia are part of the equation and always have been, and that legal immigrants are as much of a target as their illegal brethren.

Powerful groups such as the Federation for American Immigration Reform (FAIR) or the Center for Immigration Studies advocate for limits on legal immigration, and they influence Congress. My congressman, Rep. Brian Bilbray (R-Calif.), was once a lobbyist for FAIR. Little wonder that lawmakers occasionally call for a moratorium on legal immigration or that, in the 1996 welfare reform law, one group stripped of benefits was legal immigrants.

Still, Americans cling to the fantastical claim that they love and appreciate immigrants ? as long as those immigrants come legally. I blame the indoctrination that many of us went through in public schools. We were taught that the United States is a nation of immigrants, that we draw strength from our diversity, that we should cherish our cultural differences, and that people from all over the world come here for second chances and wind up building a first-rate nation.

As someone who grew up in Great Britain and came to the United States in the mid-1970s, Brimelow missed those lessons. An immigrant who is critical of immigration, he is described as a ?white nationalist? by the Southern Poverty Law Center. According to the SPLC, the website that Brimelow founded and edits is a hate site.

I would imagine that the people who invite someone like Brimelow to address their group know exactly what to expect, and his remarks to CPAC did not disappoint.

According to CBS News? ?Political Hotsheet,? Brimelow said during the panel that immigration ? both legal and illegal ? was, along with multiculturalism, damaging America by creating a ?Spanish-speaking underclass parallel to the African-American underclass.? He described Hispanic immigrants as ?completely dysfunctional? and declared the state of California as ?rapidly turning into a Hispanic slum? that is ?totally overrun by barrios of illegal immigrants.?

Anyone else feel like they need a shower?

Let me honest and clear. My Mexican-American family has been in the United States for five generations. By comparison, Peter Brimelow has been here for five minutes. No wonder he doesn?t understand the first thing about America and the values that make it great.

My only critique is that all swingers could get tagged with an ?orgy? label. Many individuals who identify as swingers have more conservative practices that involve dating and couples only get-togethers. Police talked with local authorities about professors 300 miles (480 kilometers) away in Buffalo and even sent an undercover agent on a whitewater rafting trip, where he recorded students' names and noted in police intelligence files how many times they prayed.

Detectives trawled Muslim student websites every day and, although professors and students had not been accused of any wrongdoing, their names were recorded in reports prepared for Police Commissioner Raymond Kelly.

"As a result, the NYPD deemed it prudent to get a better handle on what was occurring at MSAs," Browne said in an email. He said police monitored student websites and collected publicly available information, but did so only between 2006 and 2007.

"I see a violation of civil rights here," said Tanweer Haq, chaplain of the Muslim Student Association at Syracuse. "Nobody wants to be on the list of the FBI or the NYPD or whatever. Muslim students want to have their own lives, their own privacy and enjoy the same freedoms and opportunities that everybody else has."

Playing by the rules
In recent months, the AP has revealed secret programs the NYPD built with help from the CIA to monitor Muslims at the places where they eat, shop and worship. The AP also published details about how police placed undercover officers at Muslim student associations in colleges within the city limits; this revelation has outraged faculty and student groups.

Though the NYPD says it follows the same rules as the FBI, some of the NYPD's activities go beyond what the FBI is allowed to do.

Kelly and New York City Mayor Michael Bloomberg repeatedly have said that the police only follow legitimate leads about suspected criminal activity.

But the latest documents mention no wrongdoing by any students.

In one report, an undercover officer describes accompanying 18 Muslim students from the City College of New York on a whitewater rafting trip in upstate New York on April 21, 2008. The officer noted the names of attendees who were officers of the Muslim Student Association.

"In addition to the regularly scheduled events (Rafting), the group prayed at least four times a day, and much of the conversation was spent discussing Islam and was religious in nature," the report says.

Praying five times a day is one of the core traditions of Islam.

Jawad Rasul, one of the students on the trip, said he was stunned that his name was included in the police report.

"It forces me to look around wherever I am now," Rasul said.

But another student, Ali Ahmed, whom the NYPD said appeared to be in charge of the trip, said he understood the police department's concern.

"I can't blame them for doing their job," Ahmed said. "There's lots of Muslims doing some bad things and it gives a bad name to all of us, so they have to take their due diligence."

City College criticized the surveillance and said it was unaware the NYPD was watching students.

"The City College of New York does not accept or condone any investigation of any student organization based on the political or religious content of its ideas," the college said in a written statement. "Absent specific evidence linking a member of the City College community to criminal activity, we do not condone this kind of investigation."

Browne said undercover officers go wherever people they're investigating go. There is no indication that, in the nearly four years since the report, the NYPD brought charges connecting City College students to terrorism.

Student groups were of particular interest to the NYPD because they attract young Muslim men, a demographic that terrorist groups frequently draw from. Police worried about which Muslim scholars were influencing these students and feared that extracurricular activities such as paintball outings could be used as terrorist training.

The AP first reported in October that the NYPD had placed informants or undercover officers in the Muslim Student Associations at City College, Brooklyn College, Baruch College, Hunter College, City College of New York, Queens College, La Guardia Community College and St. John's University. All of those colleges are within the New York City limits.

A person familiar with the program, who like others insisted on anonymity because he was not authorized to discuss it, said the NYPD also had a student informant at Syracuse.

Police also were interested in the Muslim student group at Rutgers, in New Brunswick, New Jersey. In 2009, undercover NYPD officers had a safe house in an apartment not far from campus. The operation was blown when the building superintendent stumbled upon the safe house and, thinking it was some sort of a terrorist cell, called the police emerency dispatcher.

The FBI responded and determined that monitoring Rutgers students was one of the operation's objectives, current and former federal officials said.

The Rutgers police chief at the time, Rhonda Harris, would not discuss the fallout. In a written statement, university spokesman E.J. Miranda said: "The university was not aware of this at the time and we have nothing to add on this matter."

Another NYPD intelligence report from Jan. 2, 2009, described a trip by three NYPD officers to Buffalo, where they met with a high-ranking member of the Erie County Sheriff's Department and agreed "to develop assets jointly in the Buffalo area, to act as listening posts within the ethnic Somalian community."

The sheriff's department official noted "that there are some Somali Professors and students at SUNY-Buffalo and it would be worthwhile to further analyze that population," the report says.

Browne said the NYPD did not follow that recommendation. A spokesman for the university, John DellaContrada, said the NYPD never contacted the administration. Sheriff's Departments spokeswoman Mary Murray could not immediately confirm the meeting or say whether the proposal went any further.

Another report, entitled "Weekly MSA Report" and dated Nov. 22, 2006, explained that officers from the NYPD's Cyber Intelligence unit visited the websites, blogs and forums of Muslim student associations as a "daily routine."

The universities included Yale; Columbia; the University of Pennsylvania; Syracuse; New York University; Clarkson University; the Newark and New Brunswick campuses of Rutgers; and the State University of New York campuses in Buffalo, Albany, Stony Brook and Potsdam; Queens College, Baruch College, Brooklyn College and La Guardia Community College.

"Students who advertised events or sent emails about regular events should not be worried about a 'terrorism file' being kept on them. NYPD only investigated persons who we had reasonable suspicion to believe might be involved in unlawful activities," Browne said.

Misgivings
But such assurances seem to offer little comfort to some former students.

One University at Buffalo student, Adeela Khan, did end up in a police report after receiving an email on Nov. 9, 2006, announcing an upcoming Islamic conference in Toronto. The email said "highly respected scholars" would be attending, but did not say who or give any details of the program. Khan says she clicked "forward," sent it to a Yahoo chat group of fellow Muslims and promptly forgot about it.

"A couple people had gone the year prior and they said they had a really nice time, so I was just passing the information on forward. That's really all it was," said Khan, who has since graduated.

Khan was a board member of the Muslim Student Association at the University at Buffalo at the time. She says she never went to the conference, was not affiliated with it and had no idea who was speaking at it.

But officer Mahmood Ahmad of the NYPD's Cyber Intelligence Unit took notice and listed Khan in his weekly report for Kelly. The officer began researching the Toronto conference and found that one of the speakers, Tariq Ramadan, had his U.S. visa revoked in 2004. The U.S. government said it was because Ramadan had given money to a Palestinian group. It reinstated his visa in 2010.

The officer's report notes three other speakers. One, Siraj Wahaj, is a prominent but controversial New York imam who has attracted the attention of authorities for years. Prosecutors included his name on a 3 ?-page list of people they said "may be alleged as co-conspirators" in the 1993 World Trade Center bombing, though he was never charged.

The other two are Hamza Yusuf and Zaid Shakir, two of the nation's most prominent Muslim scholars. Both have lectured at top universities in the U.S.. Yusuf met with President George W. Bush at the White House following the 2001 terrorist attacks.

The post about the academic event was enough to get Khan's name mentioned in the weekly MSA report, which was stamped "SECRET" in red letters and sent to Kelly's office.

There is no indication that the investigation went any further, or that Khan was ever implicated in anything. But she worries about being associated with the police report.

"It's just a waste of resources, if you ask me," she said. "I understand why they're doing it, but it's just kind of like a Catch-22. I'm not the one doing anything wrong."

The university said it was unaware its students were being monitored.

"UB does not conduct this kind of surveillance and if asked, UB would not voluntarily cooperate with such a request," the university said in a written statement. "As a public university, UB strongly supports the values of freedom of speech and assembly, freedom of religion, and a reasonable expectation of privacy."

The same Nov. 22, 2006, report also noted seminars announced on the websites of the Muslim student associations at New York University and Rutgers University's campus in Newark, New Jersey.

Recruiting
Browne, the police department spokesman, said intelligence analysts were interested in recruiting by the Islamic Thinkers Society, a New York-based group that wants to see the United States governed under Islamic law. Morton was a leader of the group and went to Stony Brook University's MSA to recruit students that same month.

"One thing that our open source searches were interested in determining at the time was, where do Islamic Thinkers Society go ? in terms of MSAs for recruiting," Browne said.

Yale declined comment. The University of Pennsylvania did not immediately respond to requests for comment. Other colleges on the list said they worried the monitoring infringed on students' freedom of speech.

"Like New York City itself, American universities are admired across the globe as places that welcome a diversity of people and viewpoints. So we would obviously be concerned about anything that could chill our essential values of academic freedom or intrude on student privacy," Columbia University spokesman Robert Hornsby said in a written statement.

Danish Munir, an alumnus adviser for the University of Pennsylvania's Muslim Student Association, said he believes police are wasting their time by watching college students.

"What do they expect to find here?" Munir said. "These are all kids coming from rich families or good families, and they're just trying to make a living, have a good career, have a good college experience. It's a futile allocation of resources."

Convicted Madonna stalker sought by police (omg!)

(Reuters) - A man who was convicted of stalking and threatening pop star Madonna in the 1990s walked away unnoticed from the California mental health facility where he was being held and remains at large, Los Angeles police said on Thursday.

Robert Dewey Hoskins, 54, was sentenced to 10 years behind bars in 1996 after being arrested for scaling a wall around the singer's home in the Hollywood Hills and threatening to slit her throat.

Madonna testified during Hoskins' trial that she had nightmares about the homeless man from Oregon after seeing him near her home in 1995. She said her bodyguard told her Hoskins claimed she was supposed to be his wife, and "if he couldn't have me, he was going to slice my throat from ear to ear."

While Madonna was away from her home and in Florida later that year, he scaled the perimeter wall there, jumped into her pool and was eventually shot twice by a security guard.

Upon his release from prison, Hoskins was sent to a California hospital. He was eventually let go but was arrested again in July 2011 and sent to a different health facility in the Los Angeles-area community of Norwalk.

Hoskins walked off undetected from that hospital last Friday and has not been seen since. Police describe him as highly psychotic with violent tendencies when not taking medication.

AG: Bail rules should keep Sandusky inside home

(AP) ? Prosecutors asked Tuesday to have Jerry Sandusky kept indoors as part of his bail conditions, citing complaints that the former Penn State football assistant was seen outside and watching children in a schoolyard from the back porch of his home, where he remains under house arrest while awaiting trial on child molestation charges.

The state attorney general's office argued in a court filing that Sandusky's bail conditions should be revised so that he is not allowed outside except to seek medical treatment. Prosecutors said they opposed Sandusky's request to be allowed contact with his grandchildren as he awaits trial on 52 child sex-abuse charges.

"Several individuals from the adjacent elementary school have expressed concerns for the safety of children at their school and the adjacent neighborhood," prosecutors wrote. "Such concerns will only mushroom if defendant is permitted to roam at will outside his house."

The allegation he was watching children was outlined in an exhibit attached to the filing, a memo from a state investigator to a county probation officer that said a teacher and intern had reported concern for the children's safety.

"They advised the neighbor that yesterday they had the children outside for recess as it was a warmer day, and that they both witnessed Mr. Sandusky on his rear house deck watching the children play," wrote investigator Anthony Sassano on Jan. 26.

Sandusky's lawyer, Joe Amendola, did not immediately respond to requests for comment about the latest prosecution filing.

Sandusky's two-story home at the end of a dead-end street has a black and orange "No Trespassing" sign staked near the base of the driveway, while the two properties directly adjacent to his home have white signs supporting the Rape, Abuse & Incest National Network.

Nearby neighbor Jody Harrington said he has seen Sandusky walking his dog and on his back porch nearly daily, and at times when children are playing on the Lemont Elementary playground.

He said he has expressed concerns informally with other neighbors, the school principal and police, and told his children to avoid Sandusky.

"Because of due process, we have to sit and wait. But that waiting process, it's painful. It's hard," he said. "The best way to describe it is I feel very violated."

The prosecution filing regarding bail said Sandusky's son's ex-wife "strenuously objects" to her three minor children having any contact with him, and that prosecutors believe Sandusky was fortunate to be granted bail.

"The commonwealth believes that (the) defendant should be in jail," prosecutors wrote. "He has been granted the privilege of being confined in his own home, which is spacious and private and where he can eat food of his own preference and sleep in his own bed at night. House arrest is not meant to be a house party."

That court document, and several motions filed late Monday by Sandusky's lawyer, come ahead of a court hearing Friday regarding his bail modification request.

Sandusky, 68, a former longtime defensive coordinator for Penn State's football team, has maintained he is innocent of the allegations, which claim he engaged in a range of illegal acts with boys over 15 years, from touching their legs to subjecting them to violent sexual assault.

As Sandusky's lawyers prepare for trial, they have asked a judge for copies of secret grand jury testimony, the phone numbers of his accusers and other material. A 37-page pretrial discovery motion sought dozens of records from the state attorney general's office, including subpoenas, photos, unredacted passages of blacked-out documents already provided to the defense, investigative notes and psychiatric records.

Amendola asked for records related to specific young men identified in grand jury reports as Sandusky's victims. Amendola said he was given the names of eight of the 10 alleged victims late last week.

A request contained in the latest defense filings concerned an interview with a former Centre County deputy prosecutor who has said little publicly about the role she may have played in the decision not to prosecute Sandusky more than a decade ago, after a mother complained about contact between Sandusky and her son in a university football team shower.

A state police report, Amendola wrote, "describes an interview with Karen Arnold, a former assistant district attorney of Centre County, wherein she and former District Attorney Ray Gricar had extensive disagreements over a 1998 police investigation regarding the defendant." A phone number for Arnold could not be located, and strict no-trespassing signs were posted months ago at a house in Bellefonte connected to her through an online listing.

Gricar disappeared in April 2005 and was declared legally dead last year.

Sandusky wants the phone numbers of his accusers so he can obtain their phone records.

"In many cases, (Sandusky) believes the accusers may have collaborated with each other in making these false accusations," Amendola wrote.

The attorney general's office said Tuesday the defense's discovery motion was under review.

Judge John M. Cleland issued an order Tuesday adding a hearing or argument on the newest defense motions on Friday, and asking the defense and prosecution to work together to narrow the discovery issues, if possible.

Sandusky wants a list of all witnesses and a narrative of what they are expected to say on the stand, as well as the names of anyone who has come forward as a potential victim "but for various reason(s) did not fit the commonwealth's profile and/or the report was deemed to be false," Amendola wrote.

Amendola acknowledged that state criminal trial rules only require the attorney general's office to provide transcripts of prior testimony of witnesses after they have taken the stand at trial and been questioned by prosecutors.

"The defendant submits his trial in these cases will be repeatedly interrupted for extended periods if lengthy and multiple transcripts of the grand jury testimony of each witness called by the commonwealth are provided to the defendant and his attorneys only at the conclusion of the testimony of each witness," Amendola wrote.

He also asked for a copy of an interview with former football coach Joe Paterno, who died last month.

Amendola said he is opposed to a request by prosecutors to bring in a jury from outside Centre County to hear the case. He said he would file his formal response on that issue later this week.

The scandal resulted in the ousting of Paterno and school President Graham Spanier. Athletic Director Tim Curley was placed on administrative leave, and Vice President Gary Schultz, who was in charge of the university's police department, stepped down.

Schultz and Curley are charged with lying to the grand jury and failure to report to police. They maintain their innocence.
